Former Grantville Committee Member Facing RICO Allegations and Not Complying with Lawsuit

Charles “Red” Phillips appears to not want to comply with Superior Court rules in disclosing discovery for the case Royce v. Phillips.

On November 01, 2024, Mr. Royce filed a lawsuit against Charles “Red” Phillips for allegations of slander and RICO. This story can be found here. The only documents filed by Mr. Phillips are the answers to Mr. Royce’s complaint. Upon entering the discovery period, Mr. Royce filed and served Mr. Phillips with discovery requests according to Ga. R. Super. Ct. 5.2.

According to the Superior Court rules both parties must participate in the discovery process. However, Mr. Phillips appears to not only not participate in the discovery process but also makes admissions that Mr. Royce will get nothing. On February 03, 2025, Mr. Royce filed a motion to compel the discovery against Mr. Phillips. As of March 13, 2025, Mr. Phillips has not filed a response to such a motion, according to court records.

In an email exchange in December 2024, Mr. Phillips appears to not agree with Mr. Royce in the exchange of discovery documents.

On or around March 12, 2025, Mr. Phillips commented on a Facebook posting, “I don’t just answer shit just bc you want me to.” This appears to be in reference to Mr. Royce’s posting of the image filed for the motion to compel. Mr. Phillips also states in the comment “come be a man and make me, boy.” 

The RICO allegations is that of his former restaurant “Reds Grub Shack”, which appears to have closed business permanently. Mr. Phillips states in an email that “which my p.o.s. system shows actual loss on starting with your attacks.” If the documents for alcoholic beverage sales were requested and Mr. Phillips can’t produce such items, then will the city of Grantville be on the hook as well? As it appears that Mr. Phillips sold alcoholic beverages from Reds Grub Shack during a portion of time of having no valid alcohol license with the city of Grantville. 

To include records sought from the state of Georgia and Grantville, a list of purchases that derived directly from the distributor.
